Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using the DiddySMS platform — including the website at diddysms.com and the Public Developer API — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately stop using the service and refrain from any further access.

DiddySMS reserves the right to modify, amend, or update these Terms at any time and at its sole discretion. Changes become effective immediately upon posting to the website. It is your responsibility to review these Terms periodically for updates. Your continued use of the service after any modifications constitutes your acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and DiddySMS ("we," "us," or "our"). Where additional terms or policies are referenced (including our Privacy Policy), they are incorporated by reference and form part of this agreement.

2. Service Description

DiddySMS is a temporary SMS number rental platform that allows users to rent phone numbers for the purpose of receiving SMS verification codes and messages. The service provides short-term access to phone numbers that can be used to verify accounts on third-party platforms and services.

DiddySMS currently offers US phone numbers only. Every number available through the service is a United States number (country code +1). Numbers from other countries are not offered.

The DiddySMS platform is accessible through two primary channels:

• Website — The primary interface at diddysms.com, where users can sign up, browse services, rent numbers, receive SMS codes, manage their balance, and access all core platform functionality, along with documentation, frequently asked questions, and legal information.
• Public Developer API — A RESTful API that enables developers to programmatically integrate SMS number rental functionality into their own applications and workflows.

DiddySMS is not a telecommunications carrier and does not own or operate the mobile networks over which SMS messages are carried. Phone numbers made available through the service are issued by telecommunications carriers and are assigned to you temporarily, for the rental period only. The availability, quality, and reliability of phone numbers depend on carriers, mobile networks, and other factors outside our reasonable control, and are subject to change without notice.

Rented numbers are temporary. You acquire no ownership of, or continuing right to, any rented number, and any option to rent the same number again is subject to availability and is not guaranteed. A number may have been used by other people before your rental and may be assigned to someone else after it ends. Do not rely on a rented number for account recovery, ongoing login verification, or any other purpose that requires access to the number after your rental ends. DiddySMS is not responsible for any loss of access to an account or service that you registered using a rented number.

The service operates on a prepaid balance system. Users must deposit funds into their account balance before renting numbers. Prices for number rentals vary by service and carrier, and are displayed at the time of purchase. DiddySMS reserves the right to adjust pricing at any time and at its sole discretion, including in response to changes in operating costs, demand, and market conditions.

3. Eligibility

To use DiddySMS, you must be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater. By using the service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding contract.

You must not be prohibited or restricted from using telecommunications services under any applicable law, regulation, or government order. If you are located in a jurisdiction where the use of temporary or virtual phone numbers is restricted or prohibited, you are solely responsible for ensuring your compliance with local laws before using the service.

You agree to provide accurate, current, and complete information when using the platform. You are responsible for maintaining the security of your account, including keeping your password and API keys confidential, and for all activity that occurs under your account, whoever carries it out. If you suspect that someone has accessed your account without your permission, change your password and contact us promptly.

DiddySMS reserves the right to refuse service, restrict access, or terminate accounts at its sole discretion if it determines that a user does not meet these eligibility requirements or has provided false or misleading information.

4. Acceptable Use

You agree to use DiddySMS only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You are solely responsible for your use of the service and for ensuring that your activities do not violate any laws or third-party rights.

The following activities are strictly prohibited when using DiddySMS:

• Fraud and identity theft — Using rented numbers to impersonate another person, create fraudulent accounts, engage in financial fraud, or conduct any form of identity theft or deception.
• Harassment and abuse — Using the service to harass, threaten, stalk, intimidate, or otherwise abuse any individual or entity.
• Spam and botnets — Using rented numbers for mass registration of accounts, automated spam campaigns, creation or operation of botnets, or any form of unsolicited bulk messaging.
• Unauthorized verification bypass — Renting numbers for the specific purpose of bypassing security verifications on platforms where you have been banned, suspended, or otherwise restricted from access.
• Reselling or redistribution — Reselling, sublicensing, or redistributing rented numbers or SMS messages received through the service to third parties without express written authorization from DiddySMS.
• Circumventing account limits — Creating multiple DiddySMS accounts to evade usage limits, bans, or restrictions imposed on your primary account.
• Malware distribution — Using the service in connection with the creation, distribution, or propagation of malware, viruses, ransomware, or other malicious software.
• Illegal activities — Using the service to facilitate, promote, or engage in any activity that is illegal under applicable law, including but not limited to money laundering, drug trafficking, terrorism financing, or child exploitation.

DiddySMS is not responsible for how you use the phone numbers or services provided. You are solely responsible for ensuring your use complies with all applicable laws and regulations.

5. Usage Limits

To ensure fair access and maintain service quality for all users, DiddySMS enforces certain usage limits. These limits may be adjusted at any time without prior notice based on system capacity, number availability, and operational requirements.

Users are limited to a maximum of one hundred (100) concurrent active rentals at any given time. This limit applies across all access channels, including the website and the Public Developer API. Attempting to exceed this limit will result in your rental request being declined until one or more active rentals expire or are cancelled.

The Public Developer API is subject to rate limiting. API requests that exceed the permitted rate will receive an error response. Persistent or deliberate attempts to exceed rate limits may result in temporary or permanent suspension of your API access. Specific rate limit values are documented in the API documentation and may be updated at any time.

DiddySMS does not guarantee the availability of any specific phone number, carrier, or service at any time. Number inventory changes continually and depends on demand, carrier and network conditions, and other factors outside our reasonable control. We make reasonable efforts to maintain a diverse and reliable inventory, but availability may fluctuate without notice, and any service may be suspended or withdrawn at any time.

6. Payment and Refunds

DiddySMS operates on a prepaid balance system. You must deposit funds into your DiddySMS account before you can rent phone numbers. Deposits can be made through the payment methods available on the website, which currently include cryptocurrency payments.

Prices for number rentals vary by service and carrier. Pricing is displayed on the website and through the API at the time of purchase. DiddySMS reserves the right to change prices at any time without prior notice. Price changes do not affect rentals that have already been confirmed and paid for.

Deposits are non-refundable except where required by applicable law. Once funds are deposited into your DiddySMS balance, they may only be used to purchase services within the platform. DiddySMS does not offer cash withdrawals, transfers to external accounts, or refunds of deposited funds to your original payment method under normal circumstances.

Order cancellations are permitted and will result in a refund to your DiddySMS account balance. A sixty-second (60-second) cooldown period applies after a rental is initiated before a cancellation can be processed. Cancellation refunds are credited to your platform balance, not to your original payment method.

DiddySMS does not guarantee that SMS messages will be delivered to rented numbers. If a rental ends without any SMS being received, the rental price is currently credited back automatically to the balance used to pay for it. This credit is made to your platform balance only, may be changed or discontinued at any time, and is your sole and exclusive remedy for non-delivery. No other refund or compensation will be issued for failed SMS delivery, including where a message is received but its code is rejected, expired, or not accepted by the sending platform. SMS delivery depends on the sending platform, telecommunications carriers, and mobile networks, none of which are controlled by DiddySMS.

Any billing disputes must be raised within thirty (30) days of the transaction in question. Disputes raised after this period may not be considered. 7. Disclaimer of Warranties

THE DIDDYSMS PLATFORM AND ALL SERVICES, CONTENT, AND FUNCTIONALITY PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

DIDDYSMS DOES NOT GUARANTEE THAT SMS MESSAGES WILL BE RECEIVED ON ANY RENTED NUMBER. The delivery of SMS messages depends on telecommunications carriers and mobile networks, the sending platform's policies and infrastructure, carrier routing decisions, and numerous other factors entirely outside the control of DiddySMS. Some platforms actively detect and block virtual or VoIP numbers, or numbers previously used on that platform, which may prevent verification codes from being delivered.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIDDYSMS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

DiddySMS does not warrant that the service will be uninterrupted, timely, secure, or error-free. The service may be temporarily unavailable due to scheduled maintenance, unscheduled downtime, system upgrades, network issues, outages or failures of carriers or other third parties, or other events beyond our reasonable control. We make reasonable efforts to minimize disruption but accept no liability for periods of unavailability.

DiddySMS does not warrant that the results obtained from the use of the service will be accurate, reliable, or meet your requirements. Any reliance you place on the service or its outputs is strictly at your own risk. You are solely responsible for determining whether the service is suitable for your intended purpose.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIDDYSMS, ITS OWNERS, OPERATORS, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, OR VENDORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF DIDDYSMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF DIDDYSMS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICE EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO DIDDYSMS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, THE LIABILITY OF DIDDYSMS SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

9. Intellectual Property

All content, materials, features, and functionality available on or through the DiddySMS platform — including but not limited to the website design, text, graphics, logos, icons, images, software, source code, APIs, data compilations, and documentation — are the exclusive property of DiddySMS or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.

Subject to your compliance with these Terms, DiddySMS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal or internal business purposes. This license does not include the right to sublicense, sell, resell, or commercially exploit any aspect of the service.

You may not, without the prior written consent of DiddySMS:

• Copy, reproduce, distribute, modify, or create derivative works based on any part of the DiddySMS platform or its content.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying algorithms, or architecture of the service.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed on or within the service.
• Use any automated means, including bots, scrapers, or crawlers, to access the service, except to crawl and index the publicly available pages of the website as our robots.txt file permits, or as explicitly authorized through the Public Developer API.
• Frame, mirror, or otherwise incorporate any part of the service into another website or application without express authorization.

The DiddySMS name, logo, and all related trademarks, service marks, and trade names are the property of DiddySMS. Nothing in these Terms grants you any right to use the DiddySMS brand or trademarks without prior written permission.

10. Indemnification

You agree to indemnify, defend, and hold harmless DiddySMS, its owners, operators, affiliates, agents, contractors, licensors, and vendors from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

• Your use or misuse of the DiddySMS platform, including any numbers rented or SMS messages received through the service.
• Your violation or breach of any provision of these Terms of Service.
• Your violation of any applicable law, regulation, or government order, whether local, national, or international.
• Your infringement or violation of any third-party rights, including but not limited to intellectual property rights, privacy rights, and contractual rights.
• Any content, data, or information that you submit, transmit, or make available through the service.
• Any claims by third parties arising from your use of numbers rented through DiddySMS, including claims from platforms whose verification processes you participated in.

This indemnification obligation shall survive the termination of your account and these Terms. DiddySMS reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You shall not settle any such claim without the prior written consent of DiddySMS.

11. Third-Party Services

The service depends on networks and services that DiddySMS does not own, operate, or control, including telecommunications carriers, mobile network operators, the platforms that send SMS messages, and the hosting, network, and other technology services used to run the platform. These third parties operate independently of DiddySMS. The quality, reliability, speed, and availability of SMS delivery depend in part on them and on the telecommunications infrastructure they operate.

DiddySMS is not responsible or liable for any failures, delays, interruptions, or quality issues attributable to carriers, networks, sending platforms, or any other third party, including any third party engaged by DiddySMS in connection with the service. This includes, without limitation, situations where a rented number does not receive an expected SMS message, where a message is delayed, where a number becomes unavailable before or during a rental, or where a number is blocked or rejected by the sending platform.

Payment processing is handled by third-party payment processors. DiddySMS does not directly process, store, or handle your payment credentials. Your use of third-party payment services is subject to their own terms of service and privacy policies, which you should review before making a deposit.

The DiddySMS platform or its communications may contain links to third-party websites, services, or resources. These links are provided for convenience only and do not imply endorsement, sponsorship, or affiliation. DiddySMS has no control over the content, availability, or practices of third-party sites and is not responsible for any damage or loss arising from your use of them. Your interactions with third-party websites and services are governed entirely by their own terms and policies.

12. Account Suspension and Termination

DiddySMS reserves the right to suspend, restrict, or terminate your account and access to the service at any time, with or without prior notice, and for any reason, including but not limited to:

• Violation of any provision of these Terms of Service or any other applicable DiddySMS policy.
• Engaging in or facilitating fraudulent, abusive, or illegal activities through the service.
• Conduct that DiddySMS, in its sole discretion, determines to be harmful to the service, other users, any third party, or the reputation of DiddySMS.
• Extended periods of inactivity on your account, as determined by DiddySMS.
• Requests or orders from law enforcement, government agencies, or other legal processes.
• Technical or security issues that DiddySMS determines necessitate account action.

Upon termination of your account for cause (including violation of these Terms), any remaining balance in your account may be forfeited and is not eligible for refund, except where applicable law requires otherwise. Inactivity alone does not cause a balance to be forfeited. DiddySMS shall have no obligation to provide advance notice, justification, or an opportunity to cure before terminating an account for violations of these Terms.

You may voluntarily discontinue your use of the service at any time. However, this does not entitle you to a refund of any remaining balance. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

DiddySMS shall not be liable to you or any third party for any suspension, restriction, or termination of your account or access to the service, regardless of the reason.

13. API Terms

The DiddySMS Public Developer API ("API") provides programmatic access to the platform's services. Use of the API is subject to these Terms as well as any additional guidelines or documentation published by DiddySMS. By using the API, you agree to comply with all applicable terms and usage policies.

API keys are personal credentials tied to your DiddySMS account. You are solely responsible for maintaining the confidentiality and security of your API keys. You must not share, publish, or expose your API keys in public repositories, client-side code, or any other location where they may be accessed by unauthorized parties.

The API is subject to rate limiting to ensure fair usage and platform stability. Exceeding rate limits will result in throttled or rejected requests. Persistent, intentional, or automated attempts to exceed rate limits may result in temporary or permanent suspension of your API access and, at our discretion, your entire DiddySMS account.

If you believe your API key has been lost, stolen, or compromised, you must revoke it immediately from your account on the website and generate a new one. DiddySMS is not responsible for any unauthorized usage, charges, or damages resulting from compromised API keys. You are liable for all activity conducted using your API key, whether or not you authorized such activity.

The API is provided "AS IS" without any warranty regarding availability, accuracy, or performance. DiddySMS reserves the right to modify, deprecate, or discontinue any API endpoint, feature, or functionality at any time. While we will make reasonable efforts to provide advance notice of breaking changes, we are not obligated to do so. It is your responsibility to monitor API documentation and announcements for updates.

14. Governing Law and Dispute Resolution

These Terms of Service and any disputes arising out of or relating to them, your use of the service, or your relationship with DiddySMS shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any legal action, proceeding, or dispute shall be brought in a court of competent jurisdiction, and you consent to the personal jurisdiction of such courts.

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

No Waiver. The failure of DiddySMS to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by DiddySMS. No waiver shall be deemed a continuing waiver or a waiver of any other provision.

Assignment. You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of DiddySMS. DiddySMS may assign, transfer, or delegate its rights and obligations under these Terms without restriction and without notice to you.

Force Majeure. DiddySMS shall not be liable for any failure or delay in performing its obligations that results from causes beyond its reasonable control, including failures of telecommunications carriers, networks, or other third parties, internet or power outages, cyberattacks, natural disasters, labor disputes, and acts of government or regulatory authorities.

Survival. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Intellectual Property), 10 (Indemnification), and 14 (Governing Law and Dispute Resolution).

Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and DiddySMS with respect to the subject matter hereof. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
